The Ticino Administrative Court dealt with an appeal against a State Council decision terminating the appellant's employment as a police inspector. Before the court could decide the merits, the appellant's counsel notified the court on 13 October 2004 that the appeal was withdrawn. The court therefore held that the proceedings were exhausted and ordered the appeal struck out. It also decided that no court fees or costs would be levied.
Withdrawal of the appeal; mootness of the proceedings. Where the appellant withdraws the appeal before judgment, the administrative proceedings are exhausted and the court strikes the case from the docket. In the absence of a merits decision, no fees or costs are levied if the court so orders (consid. 1-2).
