RI1 appealed to the Ticino Administrative Court against a State Council decision confirming a building permit with a condition requiring removal of an opening between a storage room and the living room. Before the court decided the merits, the appellants informed the court on 6 October 2004 that they were withdrawing the appeal. The court therefore held that the proceedings were exhausted, struck the appeal from the roll, and ordered that no fees or expenses be charged.
Administrative appeal withdrawn before judgment; the court takes note of the withdrawal and strikes the case from the roll. Where the appellants no longer maintain the appeal, the proceeding is moot and no merits review is carried out. In the absence of a substantive decision, the court may order that no court fees or costs be levied (consid. 1-2).

considerato pertanto che il procedimento è così esaurito;
decreta:
