The appellant challenged the State Council’s procurement award for plasterboard wall and ceiling works connected with a cantonal school. Before the administrative court decided the merits, the appellant’s counsel notified the court on 10 April 2003 that the appeal was withdrawn. The court therefore held that the proceedings were exhausted, struck the appeal from the docket, and ordered that no fees or costs be taken.
Withdrawal of an appeal renders the proceedings moot; the court strikes the case from the roll and, absent contrary circumstances, may order that no court fees or costs be charged. The court does not rule on the merits once the appellant has validly withdrawn the remedy.
