The Ticino cantonal administrative court dealt with an appeal against a State Council resolution concerning a three-month suspension of the operating authorization and public establishment license of the restaurant Turista. Before the court decided the merits, the appellant's lawyer withdrew the appeal. The president therefore declared the proceedings exhausted, struck the appeal from the docket, and ordered that no fees or costs be charged.
Withdrawal of an administrative appeal renders the proceedings moot and justifies striking the case from the register; in the absence of a live dispute, the court does not rule on the merits and may waive court fees and costs (consid. 1-2).

la risoluzione 28 gennaio 2003, n. 432, del Consiglio di Stato, che respinge, rispettivamente dichiara irricevibile, l'impugnativa presentata dall'insorgente avverso le decisioni 12 dicembre 2002 con cui la Sezione dei permessi e dell'immigrazione ha sospeso per 3 mesi l'autorizzazione a gestire e la patente d'esercizio pubblico, relative al ristorante Turista di __________;
preso atto che il 13 febbraio 2003 il patrocinatore del ricorrente ha comunicato di ritirare il ricorso;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
