The appellant challenged the Municipality of Ascona’s award of the 2002 maintenance of the municipal sewer network. Before the administrative court decided the merits, the appellant’s counsel withdrew the appeal on 11 January 2002. The president of the Ticino Administrative Court therefore held that the proceedings were exhausted and ordered the case struck from the roll. No court fees or expenses were charged.
Appeal withdrawn; proceedings are terminated and the case is struck from the roll. In the absence of a merits decision, the court may dispose of the matter by removal from the docket and, depending on the circumstances, waive the levying of fees and expenses (consid. 1-2).
