The appellant, represented by an engineer, challenged a municipal award concerning works for the upgrading of a telemeasurement and remote-control system. Before the administrative court could decide the merits, the appellant informed the court that it was withdrawing the appeal. The Tribunal cantonale amministrativo therefore held that the proceeding was exhausted, struck the appeal from the roll, and ordered that no court fees or costs be charged.
Withdrawal of an administrative appeal; striking the case from the roll; costs. Where the appellant expressly withdraws the appeal before a merits decision, the proceeding becomes moot and must be removed from the docket. In such circumstances, and absent special reasons, no court fees or expenses are charged (consid. 1-2).
