la decisione 20 febbraio 2002, no. 742, del Consiglio di Stato, che respinge il ricorso 19 ottobre 2001 presentato dall'insorgente avverso la decisione 26 settembre 2001 del municipio di __________ con la quale viene rilasciata la licenza edilizia per opere di sistemazione esterna al mapp. no. __________ RF di __________;
preso atto che il 10 settembre 2002 il patrocinatore del ricorrente ha comunicato di ritirare il ricorso;
ritenuto che il resistente si è avvalso del patrocinio di un legale iscritto all'albo, per cui si giustifica la corresponsione di un'indennità per ripetibili;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
Il ricorrente rifonderà l'importo di fr. 500.-- al resistente a titolo di ripetibili.
