contro
la decisione 30 gennaio 2001, no. 479 che respinge l'impugnativa presentata dall'insorgente avverso la risoluzione 29 novembre 2000 con cui la Delegazione del Consorzio Casa per anziani __________ di __________ ha rescisso il rapporto d'impiego;
rilevato che in occasione dell'udienza 23 ottobre 2001, dopo discussione, il giudice delegato ha proposto alle parti di transare la vertenza mediante il seguente accordo:
"versamento di quattro mensilità di stipendio ed un'indennità per ripetibili di 2000.-- franchi.
Alle parti è assegnato un termine di 20 giorni per pronunciarsi sulla proposta, ritenuto che in caso di accettazione la causa verrà stralciata dai ruoli senza spese mentre in caso di rifiuto il tribunale assegnerà alle parti un termine per la presentazione delle conclusioni";
preso atto che il 2 novembre, la Delegazione Consorzio Casa per anziani __________ e l'8 novembre 2001, il ricorrente, hanno aderito alla proposta di cui sopra;
decreta:
Il ricorso è stralciato dai ruoli per intervenuta transazione.
Non si prelevano né tasse, né spese.
La resistente rifonderà l'importo di fr. 2'000.-- al ricorrente quale indennità per ripetibili.
