The appellant challenged the Municipality of Massagno’s decision concerning painting works, but withdrew the appeal on 2001-10-17. The Ticino Administrative Court therefore considered the proceedings exhausted and struck the appeal from the docket. It also ordered that no judicial fees or costs be charged.
Withdrawal of an appeal terminates the proceedings; where the appellant withdraws the remedy, the court strikes the case from the docket. In such circumstances, the court may order that no fees or costs be levied, depending on the procedural disposition and absence of a substantive adjudication (consid. implicit).
