Several companies appealed a municipal award for carpentry/window works related to logistics installations for swimming pools and sports club premises. Before the administrative court decided the case, the municipality informed the court that the original awardee had renounced the contract and that the works had been awarded instead to another company. The court held that the appeals had therefore become moot and removed them from the register. It also ordered that no court fees or costs be levied.
Procurement appeal; mootness after withdrawal of the contested award and new award to another bidder. Where the challenged municipal award is renounced and replaced by a subsequent award decision, the appeal loses its object and is struck off the docket (consid. 1). In such circumstances, the court may terminate the proceedings without fees or costs where the case has become devoid of object through the authority’s subsequent conduct.
