Sintesi

The appellants appealed only against the costs portion of the Council of State's decision. Before the court ruled on the merits, they informed the TRAM that they were withdrawing the appeal. The court therefore declared the proceedings concluded, struck the appeal from the docket, and ordered that no court fees or costs be taken.

Withdrawal of an appeal before judgment; the court shall strike the proceedings from the docket once the appellant withdraws the remedy. Where the case is thereby exhausted, no court fees or party costs are levied unless a specific basis for allocation exists; in the absence of such basis, the court may order that neither fees nor costs be charged (consid. 1-2).
