The appellant challenged a Council of State decision that had imposed costs and a court fee of CHF 300. Before the administrative court decided the appeal, the Council of State issued a new decision annulling those costs and fees. The court therefore held that the appeal had lost its object and ordered it struck off the roll. It also decided that no court fees or costs would be charged in the proceeding.

il dispositivo no. 2 della decisione 20 gennaio 1999, no. 152, del Consiglio di Stato, che pone a suo carico le spese e la tassa di giudizio di fr. 300.--;

preso atto che il Consiglio di Stato con decisione 10 marzo 1999, no. 1073, ha riformato il dispositivo no. 2 della risoluzione impugnata annullando tasse e spese a carico dell'insorgente;

considerato pertanto che il procedimento è così divenuto privo d'oggetto;

decreta:

  1. Il ricorso è stralciato dai ruoli perché divenuto privo d'oggetto.

  2. Non si prelevano né tasse, né spese.
