The appellants challenged a State Council decision declaring inadmissible their objection against a municipal authorization for a Natel radio base station. Before the administrative court ruled on the merits, their counsel informed the court that the appeal was withdrawn. The court therefore held that the proceedings were exhausted, struck the appeal from the docket, and ordered that no fees or costs be collected.

Withdrawal of an administrative appeal; proceedings are terminated without a merits judgment when the appellant retracts the appeal. In such a case the court strikes the matter from the roll. Absent special circumstances, and where the decision so provides, no court fees or expenses are levied (consid. 1-2).

la decisione 25 agosto 1999, no. 3404, del Consiglio di Stato che dichiara irricevibile l'impugnativa presentata il 25 maggio 1999 dagli insorgenti contro la risoluzione 17 novembre 1998 del municipio di __________, con la quale veniva concessa alla __________ un'autorizzazione per la posa di una stazione radio base per telecomunicazioni Natel;

preso atto che in data 22 settembre 1999 il patrocinatore dei ricorrenti ha comunicato di ritirare il ricorso;

considerato pertanto che il procedimento è così esaurito;

decreta:

  1. Il ricorso è stralciato dai ruoli.

  2. Non si prelevano né tasse, né spese.
