The Ticino Administrative Court dealt with an appeal against a State Council decision annulling a building permit for the raising of a residential house. la decisione 9 giugno 1999 del Consiglio di Stato (n. 2468) che annulla la licenza edilizia 11 marzo 1999 rilasciatagli dal municipio di __________ per la sopraelevazione della sua casa d'abitazione (part. n. __________ RFD);

preso atto che in data 20 agosto 1999 il ricorrente ha comunicato di ritirare il ricorso;

ritenuto che il resistente __________ si è avvalso del patrocinio di un legale iscritto all'albo degli avvocati, per cui si giustifica la corresponsione di un'indennità per ripetibili;

considerato pertanto che il procedimento è così esaurito;

decreta:

  1. Il ricorso è stralciato dai ruoli.

  2. Non si prelevano né tasse, né spese.

__________ rifonderà fr. 800.-- al resistente a titolo di ripetibili.
