The Ticino Administrative Court dealt with appeals against a State Council decision that had upheld an administrative challenge to a municipal building permit for alterations to a rustic outside the building zone. After the municipality and one appellant withdrew their appeals on 16 September 1999, the court held that the proceedings were exhausted. It therefore struck the appeals from the docket and ordered that no court fees or costs be collected.
Withdrawal of the appeal leads to striking the case from the roll; if the parties withdraw the pending remedies, the court does not examine the merits and terminates the proceedings.
