The appellant challenged a disciplinary decision of the State Council imposing a one-month suspension from teaching without salary. At the hearing on 7 May 1998, he withdrew the appeal. The Administrative Court therefore struck the case from the rolls and charged the appellant with the court fee of CHF 400 and costs of CHF 330. No review of the merits of the disciplinary sanction was undertaken.
Withdrawal of appeal; where the appellant withdraws the recourse during the hearing, the proceedings are terminated and the case is struck from the docket. In the absence of a substantive determination, the court confines itself to the procedural consequence of dismissal of the pending appeal and to the allocation of costs to the withdrawing party (consid. implicit).

la decisione 11 febbraio 1998, no. 600, del Consiglio di Stato con la quale sospende l'insorgente dall'insegnamento con privazione dello stipendio per un mese quale sanzione disciplinare;
preso atto che nel corso dell'udienza 7 maggio 1998 il ricorrente ha comunicato di ritirare il ricorso;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
La tassa di giustizia di fr. 400.-- e le spese di fr. 330.-- sono a carico del ricorrente.
