The Ticino Administrative Court dealt with an appeal against the State Council's decision revoking a driving licence. Before the court ruled on the merits, the appellant notified on 11 January 1999 that he was withdrawing the appeal. The court held that the proceedings were thereby exhausted and struck the case from the docket. It also ordered that no court fees or expenses be charged.

Withdrawal of an administrative appeal; the appellate court, once informed of a valid withdrawal, must strike the proceedings from the docket because the dispute is no longer pending. In the absence of a merits decision, the court may order no fees and no expenses, as expressly stated in the dispositive part.

decreta:

  2. Non si prelevano né tasse, né spese.
