The Ticino Administrative Court dealt with an appeal against a State Council decision authorizing the respondent to install slot machines in a building. Before the court ruled on the merits, the appellant’s counsel informed the court on 18 September 1997 that the appeal was withdrawn. The court therefore struck the appeal from the docket and considered the proceedings concluded. It ordered that no court fees or expenses be levied, but required the appellant to pay CHF 500 to the respondent as compensation for costs.

Withdrawal of appeal; termination of proceedings and costs. Where the appellant withdraws the administrative appeal, the court takes note of the withdrawal and strikes the case from the docket, the proceedings being thereby exhausted. In such a situation, the court may waive the collection of fees and expenses, while ordering the withdrawing party to pay party compensation to the opposing party for its costs (consid. 1-3).

considerato pertanto che il procedimento è così esaurito;

decreta:

  1. Il ricorso è stralciato dai ruoli.

  2. Non si prelevano né tasse, né spese.

  3. La ricorrente rifonderà fr. 500.-- alla __________ a titolo di ripetibili.
