The Ticino Administrative Court dealt with an appeal against the State Council's decision confirming a building permit for a pizza shop. Before the merits were examined, the appellant's representative informed the court that the appeal was withdrawn. The court therefore held that the proceedings were exhausted, struck the appeal from the docket, and ordered that no fees or costs be levied.
Withdrawal of the appeal renders the proceedings moot and leads to striking the matter from the roll; in such a situation the court may terminate the proceedings without charging court fees or expenses.
