The Ticino Administrative Court dealt with an appeal against a decision of the Department of Institutions, Office for Permits and Passports, concerning the law on ambulant trade and automatic machines. Before judgment, the appellant's counsel notified on 1997-06-09 that the appeal was withdrawn. The court therefore considered the proceedings exhausted, struck the appeal from the roll, and ordered that no fees or costs be levied.
Withdrawal of an administrative appeal; once the appellant unequivocally withdraws the remedy, the proceedings are terminated without a merits decision and the court orders the appeal struck from the roll. In the absence of a substantive determination, no court fees or costs are levied where the court so orders (consid. 1-2).
