The appellant withdrew its appeal against the State Council's 17 January 1995 building-permit decision. The Administrative Court therefore terminated the proceedings and struck the appeal from the docket. It ordered no court fees or expenses, but awarded the respondents CHF 800 in party compensation.
Withdrawal of appeal; termination of proceedings; costs and party compensation. When the appellant withdraws the appeal, the court strikes the case from the docket because the dispute is exhausted. In such a situation the court may waive court fees and expenses, while allocating party compensation to the prevailing respondents according to the procedural outcome (consid. 1-3).
