The Cantonal Administrative Court of Ticino dealt with an appeal alleging undue delay by the State Council in handling an appeal against a municipal resolution. Before the court decided on the merits, the appellant informed the court that he was withdrawing the appeal. The court therefore held the proceedings to be exhausted, struck the appeal from the docket, and ordered that no fees or expenses be collected.
Withdrawal of the appeal terminates the proceedings; the court strikes the matter from the roll without deciding the merits. In the absence of a substantive decision, and where the case is exhausted by withdrawal, no court fees or costs are charged (consid. implicit).
