The appellants appealed a State Council decision concerning a building permit. Before the merits were decided, their counsel asked in writing for the case to be removed from the docket, treating the request as a withdrawal of the appeal. The Administrative Court therefore held that the proceedings were concluded, struck the case from the docket, and ordered that no fees or costs be collected.
Withdrawal of appeal; striking off the docket; costs. Where the appellant clearly withdraws the appeal, the administrative proceedings are terminated without a merits ruling and the case is removed from the docket. In such a situation, the court may order that no fees or expenses be charged (consid. 1-2).
