The Ticino Administrative Court dealt with an appeal against a State Council decision on a parish tax for 1989. During the proceedings, the parish informed the court that, because of intervening legislative amendments, it was withdrawing its challenges. The court therefore struck the appeal from the docket and ordered that no fees or costs be levied.
Withdrawal of the appeal renders the administrative proceedings moot and leads to removal from the docket; in such circumstances the court may order that no fees or expenses be charged, especially where the withdrawal follows changed legal circumstances (consid. 1-2).
