The applicant sought to redeem a fine by performing public utility work. After the Sezione esecuzione pene e misure informed the court that the request could not be granted, the President of the Pretura penale ordered the proceeding struck from the docket and decided that no fees or costs would be levied.
Execution proceedings; request to redeem a fine through public utility work; if the competent execution authority indicates that the request cannot be granted, the criminal court may strike the matter from the register without entering into the merits. In such a case, no court fees or expenses are charged.
