Sintesi Omnilex

The appellant appealed a family-allowances decision of 16 April 2002. The Tribunal cantonale delle assicurazioni had previously granted a final 10-day deadline to cure formal defects in the appeal, warning that failure to comply would lead to non-entry. The deadline elapsed without correction, and no excuse was offered. The court therefore declared the appeal inadmissible and ordered that no justice fee be collected, with costs charged to the State.

Art. 1a, 2 and 8 LPAss; appeal inadmissible for failure to remedy formal defects within a peremptory deadline. Where an appeal does not satisfy the statutory formal requirements, the court may set a final time limit to cure the deficiencies under warning of non-entry; if the party lets the deadline expire unused and gives no excusable reason, the appeal is not entered into. In such a case, the court may waive the justice fee and allocate costs to the State (consid. pertinent to non-entry).
