In an accident-insurance appeal, the appellant withdrew the appeal by letter of 14 August 2003. The Cantonal Insurance Tribunal held that the case had become moot and struck it from the docket. It further ordered that no court fees or expenses be charged and notified the parties accordingly.
Legge di procedura 6.4.61; withdrawal of the appeal renders the proceedings devoid of object; the court shall strike the case from the docket and may order that no taxes or costs be levied. Where the appellant unequivocally withdraws the remedy, the deciding authority need not adjudicate the merits but merely terminate the proceedings.
