The applicant requested that an application for interim measures in occupational pension matters be struck from the docket after the respondent had paid the insurance benefits. The Tribunal cantonale delle assicurazioni held that the dispute had therefore become moot and ordered the case removed from the roll. It also ordered that no court fees or costs be collected.
Proceedings become moot when the contested benefits are paid; in that event the court may strike the case from the roll ex officio or upon request. Where the dispute has lost its object, the application for interim relief is not examined on the merits and no judicial costs are levied, subject to the applicable cantonal procedural law (consid. implicit).
