The claimant filed a petition against the respondent before the Ticino Cantonal Insurance Court. After the respondent paid the full amount in dispute, the claimant withdrew the petition. The court held that the case had become moot and ordered the proceedings struck off the docket. It also ordered that no court fees or costs be levied.
Legge di procedura 6.4.1961; when the respondent fully satisfies the claim and the claimant withdraws the petition, the dispute loses its subject matter and the court strikes the proceedings off the docket. intimazione alle parti a sensi ed effetti di legge.
