The claimant in an occupational pension case withdrew its petition after learning that the respondent had been dissolved in bankruptcy. The Cantonal Insurance Court held that the matter had become moot and ordered the case struck from the docket. It further ordered that no fees or costs be charged.
Legge di procedura 6.4.61; when the claimant withdraws the petition and the dispute loses its object, the court must strike the case from the docket. In such circumstances, absent any remaining live controversy, the proceedings are terminated without adjudication on the merits; the court may also order that no costs or fees be levied (consid. implied by the decree).

vista la lettera 25 aprile 2003 della parte attrice che, di conseguenza, comunica il ritiro della petizione;
rilevato che la causa è divenuta priva di oggetto;
viste le disposizioni della Legge di procedura 6.4.61;
decreta 1. la causa è stralciata dai ruoli;
non si percepiscono né tasse né spese;
intimazione alle parti a sensi ed effetti di legge.
