The Fondazione istituto collettore LPP filed a petition against an unnamed defendant. After the respondent paid the disputed amount, the applicant withdrew the petition. The Tribunal cantonale delle assicurazioni held that the dispute had become moot and struck the case from the docket. It also ordered that no court fees or costs be collected.
Mootness after withdrawal and satisfaction of the claim; costs. Where the claimant withdraws the action because the defendant has paid the disputed amount, the proceedings lose their object and are struck off the roll. In such circumstances, and absent contrary grounds, no court fees or costs are levied.

visto che, con lettera 8 maggio 2003 la parte attrice ha comunicato il ritiro della petizione avendo, nel frattempo, la convenuta saldato l'importo oggetto della
vertenza
rilevato che la causa è divenuta priva di oggetto;
viste le disposizioni della Legge di procedura 6.4.1961;
decreta 1. la causa è stralciata dai ruoli:
non si prelevano né tasse né spese;
intimazione alle parti a sensi ed effetti di legge.
