Fondaz. istituto collettore LPP, 6900 Lugano,

in materia di previdenza professionale
letti ed esaminati gli atti;
richiamata la petizione 17 giugno 2002 con cui la Fondazione istituto collettore LPP
di Lugano ha chiesto al TCA di condannare __________ al versamento di
fr. 2'577.35 oltre interessi al 5% a far tempo dal 18 ottobre 2001, postulando altresì il rigetto dell'opposizione interposta al PE n. __________del 22 ottobre 2001 dell'UEF di __________;
visto lo scritto 14 luglio 2002 con cui il convenuto ha riconosciuto di essere debitore nei confronti della Fondazione attrice dell'importo di fr. 2'577.35 e che sarà sua premura provvedere al pagamento di quanto dovuto nei prossimi mesi (III);
considerato che il riconoscimento della pretesa di cui allo scritto 14 luglio 2002 del convenuto configura atto di acquiescenza la quale pone fine alla lite con effetto di cosa giudicata materiale;
in applicazione degli art. 23 LPTCA, art. 352 cpv. 1 e 2 CPC;
decreta 1.- La petizione é stralciata dai ruoli per acquiescenza.
§ E' rigettata in via definitiva l'opposizione interposta al precetto esecutivo no. __________dell'UEF di __________ del 22 ottobre 2001 per l'importo di fr. 2'577.35 oltre interessi al 5% a far tempo dal 18 ottobre 2001.
2.- Non si percepisce tassa di giustizia, mentre le spese sono poste a carico dello Stato.
3.- intimazione alle parti a sensi ed effetti di legge.
