In a social-insurance matter, the claimant Foundation withdrew its petition after the court had granted the defendant a 10-day extension to answer. The Tribunal held that the dispute had become moot and struck the case from the roll. It further ordered that no court fees or costs be levied and notified the parties accordingly.
Striking out of proceedings after withdrawal of the action; mootness of the case eliminates the need for a merits decision. Where the claimant withdraws the petition before judgment, the court terminates the proceedings and may order that no taxes or costs be collected, depending on the applicable procedural law (Legge di procedura 6.4.1961).

richiamata l'ordinanza 11 settembre 2002 con la quale il Tribunale ha assegnato alla parte convenuta il termine di grazia di 10 giorni per presentare la risposta di causa (III);
preso atto che, con lettera 19.09.02, la parte attrice ha comunicato il ritiro della petizione (IV);
rilevato che la causa è divenuta priva di oggetto;
viste le disposizioni della Legge di procedura 6.4.1961;
decreta 1. la causa è stralciata dai ruoli:
non si prelevano né tasse né spese;
intimazione alle parti a sensi ed effetti di legge.
