The appellant, represented by counsel, appealed a 22 May 2002 decision of the Ticino compensation fund concerning supplementary benefits. After the respondent was given time to answer, the appellant’s lawyer withdrew the appeal by letter of 17 January 2003. The judge delegated of the Ticino Insurance Court held that the proceedings had become moot and ordered the case struck from the docket, with no court fees or costs.
Withdrawal of the appeal renders the proceedings devoid of object; in such a situation the court strikes the case from the docket and, absent special circumstances, orders that no court fees or costs be levied (Legge di procedura 6.4.61).
