The appellant challenged a decision of the Cantonal Compensation Fund concerning supplementary benefits. The Tribunal set a deadline for the respondent to answer, but before the merits were decided the appellant withdrew the appeal by letter of 1 September 2000. The court held that the case had become moot, struck it from the docket, and ordered that no court fees or costs be levied.
When an appeal is withdrawn, the proceedings become moot and the court shall strike the case from the docket; absent a live dispute, no merits ruling is rendered. In such a situation, the court may order that neither court fees nor expenses be charged (consid. on mootness and costs).
