The Ticino Cantonal Insurance Court dealt with an appeal against an invalidity insurance decision. The appellants later informed the court that the sickness fund had paid CHF 2,000 and declared that they were withdrawing the appeal. The court held that the dispute had become moot, struck the case off the docket, and ordered that no court fees or costs be levied.
Appeal withdrawal; mootness of proceedings; costs. Where appellants validly withdraw an appeal after the disputed amount has been paid, the court will strike the case from the docket for lack of object. In such circumstances, and absent special grounds, no court fees or costs are imposed (consid. II-IV).

richiamata l'ordinanza 31.5.01 con la quale la causa è stata sospesa (II);
vista la lettera 6.7.01 dei ricorrenti che comunicano l'avvenuto pagamento da parte della Cassa malati dell'importo di fr. 2'000 e, di conseguenza, dichiarano di ritirare il ricorso (IV);
rilevato che la causa è divenuta priva di oggetto;
viste le disposizioni della Legge di procedura 6.4.1961;
decreta 1. la causa è stralciata dai ruoli:
non si prelevano né tasse né spese;
intimazione alle parti a sensi ed effetti di legge.
