The Ticino Insurance Court, acting on a petition based on Art. 52 LAVS, had previously suspended the case. After the Cassa informed the court that CHF 19,996.80 had been paid on 18 June 2003 to settle the compensation claim, the court held that the case had become moot. It therefore struck the proceedings off the docket and ordered that no fees or costs be charged.

Art. 52 LAVS; mootness of proceedings after full payment of the claimed amount. Where the object of the dispute ceases to exist during pending proceedings because the asserted compensation claim is satisfied, the court must strike the case from the roll. In such circumstances, absent a remaining live controversy, no substantive adjudication is rendered and the procedural consequence is merely discontinuance; costs may be left uncharged according to the applicable cantonal procedural law (consid. 1).

visto che, con lettera 23.06.03, la Cassa ha comunicato che in data 18.06.2003 la __________ ha versato fr. 19'996.80 a saldo del credito risarcitorio e postula lo stralcio della causa (V);

rilevato che la causa è divenuta priva di oggetto;

viste le disposizioni della Legge di procedura 6.4.1961;

decreta 1. la causa è stralciata dai ruoli:

  1. non si prelevano né tasse né spese;

  2. intimazione alle parti a sensi ed effetti di legge.
