RI1 appealed a November 2003 penalty decision imposing a CHF 300 fine, court fee and costs for obstructing an oncoming cyclist. The Pretura penale held that the appeal was filed only on 5 April 2004, well after the 15-day statutory deadline under the LPContr. The appeal was therefore declared inadmissible. Because the appeal failed, the court also charged the appellant with a modest fee and costs of CHF 50.
Arts. 4 cpv. 2, 7 cpv. 5 and 15 LPContr; late appeal and procedural costs. Where an appealable decision expressly indicates the competent remedy and the party fails to challenge it within the peremptory 15-day time limit, the appeal is time-barred and must be declared inadmissible. A filing addressed to another authority does not cure lateness. In the event of inadmissibility, the court may impose a modest fee and costs on the unsuccessful appellant (consid. B-D).

Ritenuto, in fatto ed in diritto
A. Con scritto __________ __________ 2004, ma inoltrato in data __________ __________ 2004, __________ __________ ha inoltrato ricorso contro la decisione __________ __________ 2003 con cui ___________ gli ha inflitto una multa di fr. 300.-, oltre alla tassa di giustizia di fr. 60.- e alle spese di fr. 70.-, per aver ostacolato la marcia ad una ciclista sopraggiungente in senso inverso la quale cadeva ferendosi leggermente.
B. Si rileva che contro la menzionata decisione il ricorrente aveva la facoltà di interporre ricorso alla Pretura penale così come indicato in calce alla stessa; non avendone fatto uso nel termine perentorio di 15 giorni, ai sensi degli art. 4 cpv. 2 e 7 cpv. 5 LPContr, ma unicamente in data 5 aprile 2004, si deve concludere che il termine per la presentazione del ricorso è scaduto infruttuosamente .
Pertanto il ricorso è tardivo e deve essere dichiarato irricevibile.
C. Abbondanzialmente si aggiunge che anche nell'eventualità di considerare alla stregua di un ricorso lo scritto ____________________ 2004 indirizzato al Ministero pubblico, lo stesso sarebbe, per i medesimi motivi esposti in precedenza, tardivo.
D. Visto l'esito del gravame non si può prescindere dall'applicazione di una modica tassa di giustizia (art. 15 LPContr).
Per questi motivi, visti gli artt. 4, 7, 15 LPContr;
dichiara e
pronuncia: 1. Il ricorso 5 aprile 2004 inoltrato da RI1 è irricevibile.
La tassa di giustizia e le spese in fr. 50.- sono a carico del ricorrente.
