The appellant challenged a decision of the Sezione della circolazione before the Pretura penale. Before the court ruled, the authority itself requested annulment of its 31 January 2003 decision. The president therefore annulled that decision and removed the appeal of 13 February 2003 from the docket. No fees or costs were imposed.
When the challenged administrative authority withdraws or requests annulment of its own decision before judgment, the appellate proceedings may be struck off as moot; in such circumstances the court may annul the contested decision and dispense with fees and expenses (cf. consid. 1-2).
