The Ticino Pretura penale dealt with a recourse filed in 2003 against a 2003 decision. Before the court ruled on the merits, the recourse claimant informed the court in writing that the recourse was withdrawn. The judge therefore ordered the case struck from the docket and decided that no fees or costs would be charged.
Withdrawal of a recourse; striking the proceeding from the docket and costs: when the appellant withdraws the recourse before a merits decision, the court removes the case from the rolls. Absent contrary grounds, no fees or procedural expenses are levied (consid. 1-2).
