The appellant filed a recourse against a decision of the traffic department but later withdrew it in writing. The President of the Pretura penale therefore ordered the appeal struck from the docket. The court also decided that no court fees or expenses would be charged. The decision was issued by President Marco Kraushaar with secretary Paola Belloli-Ducoli.
Withdrawal of an appeal renders the proceedings without object; the court shall strike the matter from the docket and, absent a contrary order, may dispense with court fees and expenses. The merits are not examined once the appellant has validly withdrawn the recourse (consid. implied).
