The President of the Pretura penale decided on an appeal against a 16 May 2003 decision of the Sezione della circolazione. After the administrative authority asked on 2 July 2003 for annulment of its own decision, the court annulled the contested decision and struck the appeal from the docket. It also ordered that no fees or costs be collected.
When the authority whose decision is challenged requests annulment of its own measure, the appeal proceedings become devoid of purpose and may be struck off; in such a situation, the contested decision is annulled and the allocation of costs may be waived, particularly where the proceedings end without a merits determination.
