The president of the Pretura penale dealt with an appeal against a decision of the Sezione della circolazione. Before the court ruled on the merits, the traffic authority asked by letter of 11 April 2003 that its decision be annulled. The court accordingly annulled the decision of 21 March 2003, struck the appeal from the docket, and ordered that no fees or costs be collected.
Where the authority that issued the challenged administrative decision requests its annulment pending appeal, the appeal proceedings may be terminated by striking the matter from the docket; if the contested decision is annulled, no costs are levied absent a basis to the contrary.
