The convicted person sought installment payment of a CHF 200 sanction package. The President of the Pretura penale held that the court was competent to grant installment payment and that the file showed inability to pay in one lump sum. The request was therefore granted: CHF 100 corresponding to the fine was to be paid in five monthly installments, starting by 30 April 2004. In parallel, the prosecutor had already waived CHF 100 in court fees and judicial costs.
Art. 347 cpv. 1 lett. b CPP; installment payment of a fine may be authorized when the convicted person cannot pay in a single lump sum. The sentencing judge is competent to fix the amount and instalments. The decisive criterion is the debtor’s actual inability to make immediate full payment; where this is established on the file, the request is to be granted, subject to specification of the first due date and number of instalments (consid. 1).

reato previsto dall' art. 51 LTP
ed ora per statuire sull’istanza __________ __________ 2004 con la quale __________ __________ chiede di poter ottenere una rateazione del pagamento di fr. 200.-- pari alla multa, tassa di giustizia e spese giudiziarie, inflittagli con il decreto menzionato;
considerato che: - giusta l’art. 347 cpv. 1 lett. b) CPP, il giudice della Pretura penale è competente a concedere al condannato la facoltà di pagare la multa a rate e a fissarne l’importo e le scadenze;
dagli atti risulta in effetti che IS0 __________ non è in grado di operare il versamento della multa in un unico importo;
in data ____________________ 2004 il Procuratore pubblico ha condonato l'importo di fr. 100.–
relativo alla tassa di giustizia e alle spese giudiziarie.
richiamato l’art. 347 CPP,
decreta: 1. In accoglimento dell’istanza è concesso il pagamento dell'importo di fr. 100.-- pari alla multa, inflitta con DA __________/__________del __________ __________ 2004, in 5 rate mensili, la prima volta entro il 30 aprile 2004.
