The President of the Pretura penale granted the request to commute an unpaid CHF 300 fine into arrest. The fine had not been paid, collection had failed, and the fined person did not appear at the hearing. Applying the conversion rate of one day of arrest per CHF 30, the court ordered a custodial substitute of 10 days, subject to the statutory maximum of ninety days.
Art. 49 cifra 3 CP; art. 347 CPP: commutation of an unpaid fine into arrest. Where the fine remains unpaid and enforcement attempts are unsuccessful, the competent authority may order commutation according to the statutory conversion rate of one day of arrest per CHF 30 of fine, subject to the maximum of ninety days. The debtor's non-appearance does not prevent the decision if the procedural prerequisites are otherwise fulfilled.

considerato pertanto che occorre procedere alla commutazione della multa inflitta, in ragione di un giorno di arresto ogni fr. 30.-- di multa, ma al massimo novanta giorni;
