The President of the Pretura penale, acting on the Public Prosecutor's request, dealt with the execution of an unpaid CHF 1,000 fine previously imposed by DAP decree. As the fine had not been paid and collection attempts had failed, and the condemned person did not appear after being summoned, the court ordered conversion of the fine into 33 days of arrest, applying the statutory conversion rate and maximum limit.
Art. 49 cifra 3 CP; art. 347 CPP: conversion of an unpaid fine into arrest. Where a pecuniary penalty remains unpaid and enforcement attempts are unsuccessful, the competent authority may convert the fine into detention at the statutory rate of one day per CHF 30, subject to the maximum statutory cap. The conversion is an execution measure and may be ordered in the absence of the condemned person if duly summoned; the court need not re-examine the merits of the underlying conviction, but only the prerequisites for conversion and the arithmetic calculation of the substitute detention (consid. 1).
