The Pretura penale of Bellinzona held that the convicted person had paid the fine in the pending execution proceeding for commutation of the fine into arrest. As a result, Judge Marco Ambrosini ordered the proceeding struck from the docket and notified the parties.
Execution proceeding; commutation of a fine into arrest; payment of the fine removes the basis for conversion. Where the convicted person satisfies the monetary sanction, the court may strike the commutation proceeding from the rolls, since the coercive substitute measure is no longer required.
