The Bellinzona Pretura penale, sitting as single judge, granted the Public Prosecutor’s request to commute an unpaid CHF 300 fine. After finding that payment had not been made and collection attempts had failed, the court applied the statutory conversion rate of one day of arrest per CHF 30. The fine was therefore converted into 10 days of arrest. The decision was issued in the execution phase and notified to the prosecutor and the enforcement service.
Art. 49 cpv. 3 CP; art. 347 CPP: commutation of an unpaid fine into arrest. Where a fine remains unpaid and enforcement measures are unsuccessful, the competent criminal judge orders conversion at the statutory rate of one day of arrest for every CHF 30 of fine, subject to the statutory maximum of ninety days. The measure is a consequence of non-payment and failed collection efforts; the court need not revisit the merits of the underlying sanction, but only verify the prerequisites for conversion and calculate the corresponding detention term.
