The President of the Pretura penale of Ticino dealt with the Public Prosecutor’s request to convert an unpaid fine into arrest. The condemned woman had been fined CHF 400 by a 2001 decree, but payment and collection attempts were unsuccessful, and she failed to appear after being summoned. Applying the statutory conversion rate of one day of arrest per CHF 30, with a maximum of ninety days, the court granted the request and converted the fine into 13 days of arrest.
Art. 49 cpv. 3 CP; Art. 347 CPP: unpaid fine, after unsuccessful collection attempts, may be commuted into arrest at the statutory conversion rate of one day per CHF 30, subject to the maximum term provided by law. Where the pecuniary penalty has not been satisfied and the debtor does not appear, the conversion order is to be pronounced if the legal prerequisites are met; the calculation follows the prescribed ratio and remains capped by the statutory maximum.
