The condemned person asked the Pretura penale to authorize installment payment of a CHF 300 sanction imposed by a prior summary penalty decree. The president held that the court was competent to grant installment payments under Art. 347 CPP and that the file showed the debtor could not pay in one lump sum. The request was therefore admitted, and payment was ordered in three monthly installments, the first due on 28 February 2003.
Art. 347 cpv. 1 lett. b CPP; installment payment of a fine may be authorized by the president of the Pretura penale when the convicted person shows inability to pay in a single payment. The court may determine both the amount and the due dates of the installments; where the debtor cannot discharge the amount at once, the request is granted and payment terms are fixed accordingly (consid. 1).

ed ora per statuire sull’istanza 5 febbraio 2003 con la quale __________ __________ chiede di poter ottenere una rateazione del pagamento di fr. 300.-- pari alla multa, tassa di giustizia e spese giudiziarie, inflittagli con il decreto menzionato;
considerato che: - giusta l’art. 347 cpv. 1 lett. b) CPP, il giudice della Pretura penale è competente a concedere al condannato la facoltà di pagare la multa a rate e a fissarne l’importo e le scadenze;
richiamato l’art. 347 CPP,
decreta: 1. In accoglimento dell’istanza è concesso il pagamento della multa di fr. 300.-- pari alla multa, tassa di giustizia e spese giudiziarie, inflitta con DAP __________/__________del __________ 2002, in 3 rate mensili, la prima volta entro il 28 febbraio 2003.
